No AFP investigation into WikiLeaks

The government says the Australian Federal Police haven't come up with any Australian criminal offences that could be applied to WikiLeaks.

The government's received advice from the AFP over the Wikileaks leaking of official United States Government documents.

Attorney General Rober McClelland says the AFP hasn't identified any criminal offences where Australia has jurisdiction and therefore an investigation hasn't been launched.

Mr McClelland says that given the documents are classified by the United States the primary jurisdiction for any investigation remains the United States.



Assange prepares for US indictment

WikiLeaks founder Julian Assange has told Sky News he expects an indictment on US espionage charges but has pledged to release more leaked documents.

Mr Assange told Sky News it was 'increasingly likely' he would face an extradition attempt from Washington.

The 39-year-old Australian was speaking outside the Suffolk country mansion where has been bailed to stay while Sweden attempts to extradite him over allegations of sexual assault.

But he is also expecting charges in the US related to the thousands of American embassy cables revealed on WikiLeaks.

'The big risk is onwards extradition to the US and that seems to be increasingly serious and increasingly likely,' he told Sky News.

'We have heard reports that a secret indictment has been made against me in the US.

'Senior legal figures say it is approximately 80% likely and principal figures who would be responsible for such an indictment are refusing to comment, which is normal in the cast of secret indictments.'

He was later asked whether he expected to get a fair trial if he ended up facing the charges in the US. He replied: 'Absolutely not.'

And speaking immediately after being released from custody, Assange accused Swedish authorities of hampering his attempts to fight the charges there.

'I have yet to receive a single page of anything from this investigation in English,' he said.

'My lawyers in Sweden only recently with one secret court hearing took hold of 100 pages of material, in Swedish, which is yet to be translated and given to me.

'That is only a fraction of the material. There is an attempt to gag my Swedish lawyer.

'Clearing my name is not the highest work I have. Continuing my work is the highest work I have.'

A spokeswoman from the US Department of Justice would only confirm there is 'an ongoing investigation into the WikiLeaks matter'.

Earlier on Thursday, judge Mr Justice Ouseley rejected arguments that Assange was a flight risk and renewed bail, pending moves to extradite him to Sweden.

The country's director of prosecutions said the British decision did 'not change the state of the case itself'.

The Crown Prosecution Service issued a statement in response to claims it had been behind the move to appeal against Assange's bail.

'The CPS acts as agents for the Swedish government in the case concerning Mr Assange.

'The Swedish director of prosecutions this morning confirmed she fully supported the appeal,' it said.

It is understood the Australian may have to wear an electronic tag as part of his bail conditions and report to police daily.

He is staying at the Suffolk manor home of Vaughan Smith, who owns London's Frontline Club.


WikiLeaks chief fears US indictment

The founder of WikiLeaks says he fears the United States is getting ready to indict him, but insists the secret-spilling site will continue its work despite what he has called a dirty tricks campaign.

Assange spoke on Friday from snowbound Ellingham Hall, a supporter's 10-bedroom country mansion where he's confined on bail as he fights Sweden's attempt to extradite him on allegations of rape and molestation. Assange insisted to television interviewers that he's being subjected to a smear campaign and 'what appears to be a secret grand jury investigation against me or our organisation'.

He did not elaborate, but said he has retained an unnamed US law firm to represent him.

Assange has repeatedly voiced concerns that American authorities are getting ready to press charges over WikiLeaks' continuing release of about 250,000 secret State Department cables, which have angered and embarrassed US officials worldwide.

US officials are investigating WikiLeaks and considering charges against Assange, a case that if pursued could end up pitting the government's efforts to protect sensitive information against press and speech freedoms guaranteed by the First Amendment. The government suspects WikiLeaks received the documents from an Army private, Bradley Manning, who is in the brig on charges of leaking other classified documents to the organization.

A High Court judge freed Assange on bail on Thursday on condition he reside at the estate in eastern England, wear an electronic tag and report to police daily. Assange spent more than a week in prison after handing himself in to British police on December 7. He's wanted in Sweden for questioning about sex allegations levelled against him by two women he spent time with while visiting the country in August.

Swedish officials - and the lawyer for the women involved - have denied accusations from Assange and his supporters that the allegations are politically motivated.

Attempts to reach Assange's British lawyers weren't immediately successful on Friday.

Assange appeared to come close on Friday to acknowledging that Manning was one of his sources, calling him 'a young man somehow embroiled in our publishing activities'.

'We can see that he's the only person, only one of our military sources, who has been accused,' he said.

But Assange appeared to be citing media accounts of Manning's links to WikiLeaks, rather than his own knowledge. In an interview later on Friday on ABC's Good Morning America, Assange said that he had never even heard Manning's name until the press began reporting it.

Assange also claimed to have information that more 'smears' are on their way. He didn't go into detail.

Although Assange promised to focus on clearing his name, he said his first priority is to his work - which he said will continue at a faster pace now that he's back in charge.

'Now that I am back to assist the directing of our ship, our work will proceed in a faster manner,' he said in an interview with the BBC late on Thursday.
